The "Décret Tertiaire" mainly applies to tertiary-use buildings, but it can also affect industrial operators
The "Décret Tertiaire" (Tertiary Decree) can have a significant impact on industrial operations, whether you own tertiary buildings or are assessing your potential compliance obligations. This article details the specific aspects of the "Décret Tertiaire" for industrial participants and provides the essential information to understand and meet this regulatory requirement.
Which entities are affected by the "Décret Tertiaire"?
The "Décret Tertiaire" primarily targets buildings used for tertiary purposes, but it also applies to industrial sites that house administrative buildings, offices, or commercial premises. The affected buildings are categorized as follows:
Tertiary premises with a floor area exceeding 1,000 m².
Mixed-use premises with more than 1,000 m² of tertiary surface area, applicable to that portion only.
Building complexes on a single site with a cumulative tertiary activity area exceeding 1,000 m². A site is defined as a group of buildings sharing a common energy delivery point (ENEDIS or GRDF grid connections).
Key compliance obligations for industrial operators:
Once compliance with the "Décret Tertiaire" is established, the main obligations include:
Energy consumption reduction: Measures must be implemented to reduce the energy consumption of tertiary premises. Reduction targets are set for each decade until 2050. These targets can be absolute (a reduction of 40% in 2030, 50% in 2040, and 60% in 2050 compared to a baseline period) or relative (expressed as a consumption ratio in kWh/m²/year).
Monitoring and reporting (DAT'POWER): Energy consumption must be tracked and performance reported regularly. Our DAT'POWER solution is designed to support this process and integrates with OPERAT, the ADEME platform, to automate the transmission of measured consumption data, thereby facilitating regulatory compliance.
Action plan: If reduction targets are not met, action plans must be developed and implemented to improve the energy efficiency of the tertiary premises. Our energy specialists are available to assist in designing and implementing your energy action plan.
Determining your compliance status under the "Décret Tertiaire"
To assess your compliance obligations under the decree, the following steps apply:
Surface area calculation: Measure the total floor area of all tertiary spaces, including offices and commercial areas.
Deadlines verification: Check the deadlines set by the decree for declaring the initial reference year to ensure compliance.
Expert consultation: For further clarification, our energy efficiency specialists can assist in verifying your status relative to the "Décret Tertiaire" requirements.
